Felony Assault with a Deadly Weapon and Misdemeanor Battery

Client was charged with the serious felony of assault with a deadly weapon and misdemeanor domestic violence. Joel heard the plight of his client from the beginning and how her boyfriend was setting her up. Joel took the time to listen to his client and find out her story and what had happened. After hearing the situation, Joel provided advice to the client to do some items proactively in order to help with the case. After appearing in Court and looking at the evidence, Joel and the client determined that we should get ready to go to trial and fight these allegations. Client was really scared about what the implications would be on her custody battle. On the day of trial, Joel appeared in Court ready to go to trial. He had all the evidence and witnesses to support his position. Upon seeing the evidence and what Joel had prepared, the DA determined that negotiating the case was the best bet. The DA wanted the client to have a conviction on her record. Joel did not stand for that result and continued to fight. Ultimately, Joel was able to secure a total dismissal of all the charges against the client. The client was able to keep custody of her son.

Felony Unlawful Acts Regarding Computers

Client was charged by way of a 30 count criminal complaint, charging him and four other co-defendants with Unlawful Acts Regarding Computers and Theft. The client was accused of an elaborate scheme with co-defendants to manipulate casino games to provide them with a pay out of credits to their awards accounts and future gaming. The Nevada Gaming Control Commission’s investigation began and client hired Joel Mann at the onset of the investigation. Joel was able to avoid the client from dealing with the investigators but unfortunately an arrest warrant was issued. Joel quickly was able to get the arrest warrant quashed and client was able to do an own recognizance release walkthrough. Joel received pages and pages of discovery along with 500 gigs of data and surveillance. Once Joel had reviewed the evidence he worked quickly to resolve the matter. Joel was able to provide the District Attorney with the information necessary to explain that client’s real liability was a misdemeanor and not multiple felonies. Joel was able to get the case reduced without the client even having to come into Court again. Client was extremely happy as he was able to keep his job by avoiding a felony or gross-misdemeanor.

Attempted Murder, Battery with Substantial Bodily Harm with a Deadly Weapon

Details:

Client was arrested after he was alleged to have been involved in a road rage incident. Client was accused of firing his 9mm semi-automatic weapon out of a moving car and striking a driver of another car and missing the passenger. Client was driving from California to Nevada when he encountered another car that was driving erratically. He pulled over to the next lane to try and pass the car but the car would not allow him to pass. This went on for several miles. Eventually words were exchanged and gestures made. Client was able to get past the other car and pulled off at the Primm exit. While on the exit ramp other car pulled in-front of Client and cut him off. The occupants in the other car got out of the car and made it almost impossible for Client to get past. Client drove by and fired two shots, hitting the driver of the other car in the stomach. The driver was air lifted to University Medical Center and immediately went into surgery. Client drove away from the scene of the incident and was eventually arrested just outside of Las Vegas. This incident received media attention and was reported for several days as a road rage incident accusing Client of horrific acts. Joel Mann was hired and filed a motion before the Justice Court and was able to get a reasonable bail amount. Once client was out of custody, Joel went to work on trying to figure out what really happened. After an investigation Joel discovered issues that would indicate the Client was acting in self-defense. Joel convinced the prosecutor that there were problems with the case and he was able to get a case that demanded mandatory prison time, down to a misdemeanor with a small fine. Client did not have to serve an additional day in jail and will be able to seal his record in two years.

Misdemeanor, Domestic Violence and Felony, Revocation of Probation

Details:

Client’s mother came to Joel Mann as Client had been arrested on a domestic violence charge while he was on probation in three different felony cases. Client was looking at substantial time in prison if he did not get acquitted of the new domestic violence charge. The Police reports indicated that Client’s girlfriend called the police and told the police that Client had body slammed her 6 – 7 times. The police arrested the Client based on her representations that he had beat her. Once Joel Mann started working on the case, he met with the Client in jail and discussed the case with him. During the conversation Joel was able to determine that there was significant issues to be used in trial. Joel put the case on calendar and invoked the Client’s Constitutional right to a Speedy Trial. Within two weeks a trial was conducted before the Las Vegas Justice of the Peace. During trial, Joel was able to get the Client’s girlfriend to admit that she had made up the accusation because she found what she believed was a receipt indicating that Client was cheating on her. After listening to Joel Mann cross-examine her, the Judge determined that the so called “victim” was in fact lying and found the Client NOT GUILTY. The Judge was so upset that Joel Mann was able to expose the girlfriends lies that the Judge called the girlfriend in and threatened to throw her in jail for lying. Within one week after the Client’s acquittal Joel was able to get all his felony probations reinstated and Client released from jail. Client is now walking around and no longer looking at 9 years in prison.

Felony, Possession of a Controlled Substance with Intent to Sell

Client went to the Electric Daisy Carnival (EDC) with some friends. The Police believed that once client was inside he started to offer ecstasy to other people for sale. Client was arrested on the spot and was found with several ecstasy pills along with marijuana on him. He was taken to the Clark County Detention Center (CCDC) where he remained for several days. His family hired Joel Mann, and within hours he was able to be released from jail. Joel sat down with the client and was able to determine where the State had weaknesses in the case. Joel was able to use this weakness in negotiating a dismissal. Client had to complete counseling, pay a fine, and stay out of trouble. Because of Joel’s negotiation the case was dismissed and the client is now sealing his record.

DUI 1st Offense

Details:

Client had struck the center median of Flamingo. His car was wrecked and he was sitting in the middle of the road with a bloody hand and blood clothes. The Officer’s immediately suspected alcohol and started the field sobriety tests on the Defendant. Police policed they had probable cause to do a breath test. Client blew a .280 (over three times the legal limit). When the client came to see Joel he knew his situation was impossible. He was about to lose everything he worked for, he was in the military and a DUI conviction would end his military career. The Defendant was about to be deployed to Afghanistan, and a trial would end his ability to fight for his country. Joel Mann was able to successfully delay the case for over a year for the Defendant to return to the United States. Once he was back, Joel Mann negotiated with the prosecutor and was able to get a DUI conviction off the table. Thanks to Joel the Defendant will be able to keep his military career with the reckless driving negotiation.

Battery Strangulation

Client was arrested and accused of strangling a girlfriend of his. The police believed that he was out at a bar drinking with his friend, they got into an argument and she went back to his house. Once they were back there the argument got more heated. She wanted to leave the house even though she was very drunk. The police believed that the Defendant tried to stop her from leaving the house and he was strangling her in order to stop her from leaving. When Joel met with the Defendant, he was very distraught as he had never been in trouble before and stated that this was all a big misunderstanding. Joel investigated the case, reviewed the police reports, and spoke with the prosecutor. Joel was able to convince the prosecutor that the police got the facts wrong and that the Defendant was innocent of the alleged charges. Joel Mann was able to get the prosecutor to agree to drop all the charges at the next Court hearing. The Defendant was able to save his job and is now sealing his record to keep any reference of this arrest off his record.

Solicitation of Prostitution

Details:

Client was arrested while visiting Las Vegas. He was staying the night at the Planet Hollywood Casino when he decided to go to one of the casino bars. While getting a drink at the casino bar he struck up a conversation with an attractive woman. The conversation went on for a while and there was a lot of flirting back and forth. The woman surprised the client by asking him if he was looking to have a little fun. The answer was of course what did she have in mind. She went on to tell him that she would do things for him. Being interested he inquired further and she explained that there would be a cost. He explained to her that he was not interested at this time but would take her number if he would become interested later. She pushed further about when he would call, when they could meet up, etc. He agreed to go and talk about more of the details in his room if she was interested. They started walking to the elevators and when he got to the elevators he was arrested by a vice team that was waiting. The woman was obviously an undercover cop and had just nabbed one of many people for solicitation of prostitution. Client hired Joel to represent him on this extremely embarrassing situation. Client was desperate not to have any conviction associated with this type of arrest. Joel talked to the prosecutor and was able to get the case dismissed with a small fine and one class. Client was then able to seal his record and have the entire incident removed from his record.

DUI Second Offense

Details:

Client was found in the middle of the road with two flat tires after hitting the median. Concerned citizens call 911 regarding car in the middle of the road without hazards. Client is arrested on suspicion of drunk driving. On the day of the trial, the prosecutor moves for a continuance as an essential witness is not available. Judge was about to grant the continuance when Joel Mann discovered that there was an error in the prosecutor’s subpoena. Joel was able to argue right then and there that the law did not allow for the prosecutor to be granted a continuance and that his client’s case should be dismissed. Prosecutor tried to correct the mistake but Joel’s legal argument trumped anything the prosecutor could do. Because Joel’s was able to find the constitutional due process violation his client case was dismissed.

Drawing and Passing a Bad Check

Client was a long time gambler at the Wynn Casino. He knew Steve Wynn and was given casino markers by his top advisers. He was considered a high level gambler and would come to Las Vegas to gambles 100 of thousands of dollars. As with everyone in this country the economy went bad and he was suddenly no longer able to pay his casino debt. He tried to negotiate with the Wynn on his own but with no success. The Wynn sent the case to the Clark County District Attorney’s Office and requested prosecution on the bad debt. Before being arrested the Defendant hired Joel Mann to help him with his Casino Marker case. Joel was able to arrange the Las Vegas Justice of the Peace to quash his arrest warrant and let him be processed without being in custody. As the case was ready for preliminary hearing Joel was able to get the case dismissed in the Las Vegas Justice Court. The DA wanted to prosecute the Defendant, so they took the case to the Clark County Grand Jury. The Jury not hearing all of he evidence returned a true bill and indicted the Defendant. Up in District Court, Joel Mann was able to convince the District Court Judge that the State of Nevada and the Clark County District Attorney’s Office failed to follow the law and improperly indicted his client. With his legal ability he was able to get the Casino Marker Indictment dismissed against his client.
