When someone’s arrested for a DUI they actually have an option to consent to a blood evidentiary test, a blood or breath evidentiary test. However, under Nevada law, if they refuse to do a blood or breath test they could actually lose their license for one year. Now when they actually refuse to do that evidentiary test the officer needs to then go and get a warrant. If they get a warrant, you end up doing the blood test or breath test anyway but you will have lost your license for a year.
